Pfizer and 1,400 Jobs to Leave City that Won Land-Use Case” in The New York Times adds an interesting chapter to the case of using eminent domain in economic development projects. The land-use case was Kelo v. New London and it went before the U.S. Supreme Court in 2005. The ruling was that eminent domain could be used by a governmental entity to obtain property for use in economic development and urban revitalization, even if the properties were to be turned over to a private developer. Many states legislated restrictions to address limiting property owner rights and to encourage responsible economic development.
